Posticy Terms and Conditions
1. Introduction
Welcome to Posticy.com (“Posticy”), an online software platform operated by Posticy GmbH, designed to facilitate professional collaboration between Marketers and Publishers for advertorials, guest posting, and sponsored content opportunities.
Posticy may also offer optional paid features, add-on services, or professional services directly to Users, subject to separate descriptions and pricing.
These Terms and Conditions form a legally binding agreement between you (“User”) and Posticy GmbH (“Company”, “we”, “us”, “our”). By accessing, registering, or using the Platform, you confirm that you have read, understood, and agreed to these Terms, together with all referenced policies, including the Privacy Policy, Cookie Policy, and User Guidelines.
Posticy is provided exclusively on a business to business basis. By using the Platform, you confirm that you act in a professional or commercial capacity, either on behalf of a legal entity or as a self employed professional. Consumer protection laws do not apply.
Posticy operates solely as a software as a service platform facilitating communication and workflow between independent Marketers and Publishers. Posticy is not a party to any agreement between Users, does not process payments between Users, and does not guarantee the performance, quality, or outcome of any collaboration.

Posticy reserves the right to amend or update these Terms at any time. Updated versions will be published on the Platform and become effective upon publication. Continued use of the Platform constitutes acceptance of the updated Terms.
If you do not agree with these Terms, you must discontinue use of the Platform immediately.
2. Definitions
For the purposes of these Terms and Conditions, the following definitions shall apply:
- Posticy – Refers to Posticy GmbH, the legal entity operating the Posticy platform.
- Platform – Refers to the website www.posticy.com and any related software, tools, features, or services provided by Posticy.
- User – Refers to any business entity or professional user who has registered an Account and accesses or uses the Platform in a commercial capacity.
- Account – Refers to a registered user profile created by a User to access and use the Platform functionalities.
- Marketer – Refers to a User who submits Proposals, Content, or collaboration requests to Publishers via the Platform.
- Publisher – Refers to a User who offers publication opportunities or digital properties and may accept Proposals via the Platform.
- Proposal or Publication Proposal – Refers to a request initiated by a Marketer through the Platform to collaborate with a Publisher regarding content placement or publication.
- Subscription Plan – Refers to the selected access plan governing a User’s usage limits on the Platform, including Free, Pro, or Premium.
- Free Plan – Refers to a subscription plan with limited monthly usage, provided at no cost and subject to modification or withdrawal at Posticy’s discretion.
- Pro Plan – Refers to a paid subscription plan with increased monthly usage limits, billed on a recurring basis.
- Premium Plan – Refers to a paid subscription plan providing unlimited Proposal submissions and acceptances, subject to abuse prevention rules.
- Usage Limits – Refers to the maximum number of Proposals a User may submit or accept during a billing cycle, as defined by the active Subscription Plan.
- Content – Refers to any text, images, links, media, or other materials submitted by Users through the Platform.
- Article – Refers to written Content submitted by a Marketer for potential publication by a Publisher.
- Order – Refers to a cooperation agreed directly between a Marketer and a Publisher following acceptance of a Proposal. Posticy is not a party to such cooperation.
- Third Party Services – Refers to external services, tools, or payment processors integrated with or linked to the Platform.
- Agreement – Refers to the legally binding agreement between the User and Posticy governed by these Terms and Conditions.
These definitions apply throughout these Terms and are intended to clarify the rights, obligations, and limitations applicable to use of the Platform.
3. Eligibility and Registration
3.1 Eligibility
The Platform is available exclusively to business users. To use Posticy, you must:
- be at least 18 years old
- have the legal capacity to enter into binding agreements
- act in a professional or commercial capacity on behalf of a business entity or as a self employed professional
By registering, you confirm that all information provided is accurate, complete, and kept up to date. Posticy reserves the right to refuse, restrict, suspend, or terminate Accounts that do not meet these eligibility requirements or appear to be used for non commercial purposes.
3.2 Registration Process
Access to the Platform requires the creation of an Account.
During registration, Users must provide a valid email address and secure login credentials. Posticy may request additional information or verification where reasonably necessary to ensure compliance with these Terms.
Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their Account.
3.3 User Roles
Each Account may operate in one or both of the following roles:
- Marketer, submitting Proposals and Content
- Publisher, offering publication opportunities and accepting Proposals
Users may switch between roles within the same Account, provided they comply with these Terms and applicable Platform rules.
The creation or use of multiple Accounts to bypass usage limits, subscription restrictions, or enforcement actions is strictly prohibited.
3.4 Account Verification
Posticy reserves the right to verify the identity, business status, or authority of any User at any time and to request supporting documentation.
Failure to provide requested verification may result in restriction, suspension, or termination of the Account.
3.5 Account Security and Responsibilities
Accounts are personal to the registered User and may not be shared, transferred, or assigned to third parties.
Users must promptly notify Posticy of any suspected unauthorized access or security breach.
Posticy is not responsible for losses or damages resulting from compromised Accounts caused by User negligence or failure to secure login credentials.
4. Platform Usage
4.1 General Rules
Users must use the Platform in compliance with all applicable laws, regulations, and professional standards.
Users must not engage in any fraudulent, misleading, deceptive, or abusive behavior when using the Platform.
Users are solely responsible for all activities conducted through their Account and for ensuring that their use of the Platform complies with these Terms and with the limits of their active Subscription Plan.
4.2 Acceptable Use
The Platform may not be used to:
- promote illegal, harmful, deceptive, or offensive content
- infringe intellectual property rights or other third party rights
- engage in spam, harassment, intimidation, or abusive conduct
- distribute malware, malicious software, or harmful code
Users must ensure that all Content submitted through the Platform is lawful, accurate, and professionally appropriate.
4.3 Prohibited Conduct and Restrictions
Users must not:
- attempt to bypass, manipulate, or exceed the usage limits of their Subscription Plan
- artificially inflate, mass submit, or abuse Proposal activity
- use the Platform for purposes other than legitimate professional collaboration
- scrape, harvest, or extract data without explicit authorization
- use automated scripts, bots, or similar tools to access or influence the Platform
- interfere with the security, stability, or integrity of the Platform
Any unauthorized access attempts, security violations, or misuse of Platform features may result in immediate restriction, suspension, or termination of the Account without prior notice.
5. Subscription Plans and Usage Limits
Posticy operates exclusively as a software as a service platform and does not act as a financial intermediary, escrow service, or payment processor between Users.
Access to the Platform and its functionalities is provided through subscription plans with defined usage limits. Usage limits determine how many Proposals a User may submit and accept within a billing cycle.
Posticy offers the following subscription plans.
5.1 Free Plan
The Free plan allows Users to:
- submit up to five Proposals per billing cycle
- accept up to five Proposals per billing cycle
Usage limits reset automatically per User based on the plan activation date.
The Free plan is provided at no cost and may be limited, modified, or discontinued by Posticy at any time.
5.2 Pro Plan
The Pro plan allows Users to:
- submit up to ten Proposals per billing cycle
- accept up to ten Proposals per billing cycle
The Pro plan is offered as a recurring paid subscription. Usage limits reset per billing cycle.
5.3 Premium Plan
The Premium plan allows Users to:
- submit an unlimited number of Proposals
- accept an unlimited number of Proposals
The Premium plan is offered as a recurring paid subscription.
Unlimited usage does not permit automated behavior, scraping, mass submissions, or abusive activity. Posticy reserves the right to temporarily restrict usage, downgrade, suspend, or terminate Accounts in cases of abuse or misuse of the Platform.
5.4 Plan Changes, Upgrades, and Downgrades
Users may upgrade their subscription plan at any time. Upgrades take effect immediately and usage limits are increased instantly, with proportional price recalculation where applicable.
Downgrades take effect at the next billing cycle. If a User has exceeded the limits of the downgraded plan, the Account remains active but the User will not be able to submit or accept additional Proposals until the next usage reset.
5.5 Billing and Cancellations
Paid subscription plans are billed on a recurring basis until cancelled.
Subscriptions may be cancelled at any time, with effect at the next billing cycle. No refunds are provided for partially used billing periods.
If a payment fails, the User’s Account may be automatically downgraded to the Free plan.
6. User Responsibilities
Users are solely responsible for their conduct, interactions, and agreements with other Users on the Platform.
Posticy does not supervise, manage, guarantee, or enforce performance, timelines, delivery, or outcomes of any collaboration between Users.
6.1 Publisher Responsibilities
Publishers are responsible for:
- the ownership, operation, and legality of their websites or digital properties
- ensuring that all published Content complies with applicable laws and regulations
- providing accurate, complete, and non misleading information about their websites and offerings
Publishers independently decide whether to accept or reject Proposals. Posticy does not impose response times, delivery deadlines, publication requirements, or guarantees.
6.2 Marketer Responsibilities
Marketers are responsible for:
- ensuring that all submitted Content is lawful and does not infringe intellectual property or other third party rights
- providing clear, accurate, and professional instructions when submitting Proposals
- communicating directly with Publishers regarding expectations, revisions, or clarifications
Posticy does not guarantee the acceptance, publication, or performance of any Proposal.
6.3 Content and Website Standards
Users must not submit or publish Content that includes:
- illegal activities
- hate speech, discrimination, or harmful material
- deceptive, misleading, or false claims
- malware, malicious software, or harmful code
Publishers must ensure that their websites:
- operate in compliance with applicable laws
- do not promote prohibited categories
- do not misrepresent traffic data, authority metrics, ownership, or audience information
6.4 Prohibited Categories
Websites or Content promoting the following are not permitted on the Platform:
- adult or explicit material
- gambling or betting services
- counterfeit, illegal, or restricted goods
- hacking, fraud, scams, or deceptive schemes
- unlicensed medical or financial services
- weapons or other restricted products or services
This list is non exhaustive and may be updated by Posticy at any time.
6.5 Moderation and Enforcement
Posticy reserves the right to:
- review, approve, reject, or remove website listings
- remove Content from the Platform
- restrict, suspend, downgrade, or terminate Accounts
Enforcement actions may be taken without prior notice. Posticy is not obligated to provide explanations or offer appeal procedures, though it may do so at its discretion.
Unless explicitly agreed otherwise in writing, content or services provided by Posticy do not transfer intellectual property rights beyond what is required for their intended use.
6.6 Payments Between Users
Marketers pay Publishers directly for content publication or related services.
Posticy does not charge commissions, does not collect payments on behalf of Users, and does not participate in financial transactions between Marketers and Publishers.
For convenience, the Platform may offer optional tools or integrations that assist Users with invoice generation or payment workflows through third-party providers such as PayPal or Stripe. Such tools are provided solely as a facilitation feature and do not constitute payment processing, invoicing, or financial intermediation by Posticy.
7. Refunds, Chargebacks, and Payment Disputes
7.1 No Refund Policy
All purchases made on the Platform, including paid subscription plans, are final and non-refundable.
Subscriptions may be cancelled at any time, with effect at the next billing cycle. No refunds are provided for partially used billing periods.
No refunds are granted for:
- unused subscription capacity
- rejected, ignored, or unsuccessful Proposals
- dissatisfaction with outcomes or results
By purchasing a paid subscription, Users explicitly waive any right of withdrawal to the extent permitted under applicable B2B laws.
7.2 Chargebacks and Payment Disputes
Initiating a chargeback or payment dispute through an external payment provider without valid legal grounds constitutes a violation of these Terms.
Posticy reserves the right to:
- immediately restrict, suspend, or terminate the User’s Account
- revoke access to paid subscription features without compensation
- recover incurred fees, penalties, or administrative costs
- contest chargebacks with supporting evidence
Posticy does not mediate financial disputes between Users.
8. Payments to Posticy and Additional Services
Payments made on the Platform are for services provided directly by Posticy.
Any invoicing or payment facilitation tools made available through the Platform for transactions between Users are provided for convenience only. Posticy does not issue invoices on behalf of Users and is not responsible for tax compliance, payment execution, or settlement between Marketers and Publishers.
These services may include, but are not limited to:
- subscription plans (Free, Pro, Premium)
- one-time or recurring add-on features
- paid visibility or promotional features for listings
- SEO metrics updates or verification services
- content creation or editorial services provided by the Posticy team
- other platform related services or features offered from time to time
Pricing, scope, and availability of such services may vary and will be presented to Users before purchase.
8.1 Nature of Payments
All payments to Posticy are made solely for services provided by Posticy.
Posticy does not:
- process payments between Users
- collect funds on behalf of Publishers
- act as an escrow service or financial intermediary
- participate in pricing, billing, or settlements between Marketers and Publishers
Any financial arrangements between Marketers and Publishers are handled independently and off-platform.
8.2 Billing and Taxes
Paid services may be offered as:
- recurring subscriptions
- one-time payments
- usage based or feature based fees
All prices are displayed exclusive of VAT unless stated otherwise. VAT is applied according to applicable EU B2B regulations.
Invoices for services provided by Posticy are issued directly by Posticy GmbH.
8.3 No Guarantee of Results
Unless explicitly stated otherwise, Posticy does not guarantee outcomes, performance, traffic, rankings, publication success, or commercial results for any paid service, including but not limited to SEO related services or content creation.
8.4 Changes to Paid Services
Posticy reserves the right to modify, discontinue, or introduce paid services, features, or pricing models at any time.
Such changes may be applied with or without individual user notification.
9. Prohibited Activities
To protect the integrity, security, and proper functioning of the Platform, Users must not engage in prohibited activities.
Prohibited activities include, but are not limited to:
- fraudulent behavior, including providing false information or misrepresenting identity, business status, or authority
- creating or using multiple Accounts to bypass usage limits, subscription restrictions, or enforcement actions
- unauthorized access to the Platform, including hacking, scraping, data harvesting, or attempts to circumvent security measures
- misuse or abuse of subscription plans, usage limits, or paid add-on features
- manipulation of Platform features, metrics, visibility, rankings, or workflows
- use of the Platform for unlawful, deceptive, or harmful purposes
- submission or publication of Content that violates applicable laws, infringes intellectual property rights, or contains hate speech, discrimination, or offensive material
- automated behavior, mass spam activity, or other actions that negatively affect Platform performance or other Users
Violations of these rules may result in enforcement actions, including limitation of functionality, forced downgrade, suspension or termination of Accounts, restriction of Platform access, and legal action where appropriate.
Users may report suspected violations through Posticy’s support channels for review and investigation.
10. Intellectual Property
All intellectual property rights related to the Platform, including software, source code, designs, interfaces, text, logos, trademarks, and related materials, are owned by or licensed to Posticy.
Users are granted a limited, non exclusive, non transferable right to access and use the Platform solely for its intended business purpose and in accordance with these Terms.
Users retain ownership of the Content they submit through the Platform. By submitting Content, Users grant Posticy a non exclusive, worldwide, royalty free license to host, store, display, reproduce, and process such Content solely for the operation, maintenance, and improvement of the Platform.
Posticy does not claim ownership of User Content and does not verify, endorse, or guarantee the legality, accuracy, or compliance of such Content.
Intellectual Property Infringement
Posticy respects intellectual property rights and provides a mechanism for reporting alleged infringement.
Upon receipt of a valid infringement notice, Posticy may remove or restrict access to the relevant Content and may take appropriate enforcement actions.
Repeated or serious infringement may result in restriction, suspension, or termination of the User’s Account.
11. Confidentiality
Users agree not to disclose non public technical, operational, or business information related to the Platform that they obtain through use of the services, unless disclosure is required by law.
Posticy does not impose confidentiality obligations on communications, negotiations, or agreements between Users beyond what is required by applicable law.
Posticy may process, store, and review communications and data to the extent necessary for Platform operation, security, compliance, and enforcement of these Terms.
12. Privacy and Data Protection
Posticy is committed to protecting personal data and complying with applicable data protection laws, including the General Data Protection Regulation.
Posticy collects and processes personal data such as registration information, account details, usage data, billing information related to subscription plans and paid services, and technical metadata in order to operate, maintain, and improve the Platform.
Detailed information about data processing practices is provided in the Privacy Policy, which forms an integral part of these Terms.
The Platform uses cookies and similar technologies to ensure functionality and enhance user experience. Further information and preference management options are available in the Cookies Policy.
Users may exercise their data protection rights, including access, rectification, restriction, or deletion of personal data, by submitting a request through Posticy’s support channels.
Posticy may engage third party service providers for hosting, analytics, infrastructure, and payment processing related solely to payments made to Posticy. Such providers are contractually bound to confidentiality and data protection obligations.
Appropriate technical and organizational measures are implemented to safeguard personal data.

13. Suspension and Termination
Posticy reserves the right to restrict, suspend, downgrade, or terminate Accounts at its sole discretion in cases of:
- violation of these Terms or User Guidelines
- misuse or abuse of the Platform, subscription plans, or paid services
- fraudulent, deceptive, or unlawful activity
- failure to complete payment for subscription plans or other paid services
Suspension may be temporary or permanent. Posticy is not obligated to provide prior notice or detailed justification.
Upon termination, access to the Platform is revoked and any remaining subscription access or paid features are forfeited without compensation.
Users may submit an appeal through the support system. Review of appeals is conducted at Posticy’s discretion and decisions are final.
Posticy reserves the right to pursue legal action where appropriate.
14. Miscellaneous
These Terms, together with the Privacy Policy and any referenced guidelines, constitute the entire agreement between the User and Posticy and supersede any prior agreements or understandings.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Posticy is not liable for delays or failures caused by events beyond reasonable control, including force majeure events, technical failures, or regulatory actions.
Users may not assign or transfer their rights or obligations under these Terms without prior written consent from Posticy.
These Terms are governed by the laws of Germany. Exclusive jurisdiction lies with the competent courts at the registered seat of Posticy GmbH.
Users consent to receive legally relevant communications electronically. Electronic records and electronic signatures are considered legally binding.
